Abstract

Due to the interaction and regulation in the European scale money transfers taking place, in majority, from the public sector to the private sector, undoubtedly European Public Procurement Law has infl uence on economy. In face of a present (January 2013) world economic crisis, searching for law solutions which would contribute to improvement of economic situation gains meaningful signifi cance. Law changes demand research tools which allow for identifi cation of chances and dangers connected with amendments implementation. Traditional legal tools, although they constitute a starting point for research, do not always provide enough knowledge about the effects of implementation. Austrian School of Economics (ASE) is one of the economic schools which can help in studying social and economic aspects of changes in law. It emphasizes the signifi cance of units as conscious actors of even more complex legal and economic systems. Special attention should be paid to the research regarding legal articles characterized by a political aspect as they may collide with the main function of Public Procurement Law, namely economic rationalization of expenditure.
